Electric-pulse fishing method banned after Netherlands CJEU appeal fails

The EU’s electric-pulse fishing ban will go ahead after an appeal by the Netherlands to the Court of Justice of European Union (CJEU) failed.

The fishing method was banned by the European Parliament in February 2019 and a blanket ban was due to come into effect this summer, but the Netherlands were unhappy with the decision and brought the decision of the European Parliament before the CJEU because they believed that the facts of electric-pulse fishing had been misrepresented during the vote.

The decision of the Court was announced this morning and has been widely welcomed by artisanal fishers and non-governmental bodies such as the BLOOM Association which had campaigned against its introduction.

The European justice considered in its judgment that the Netherlands had not demonstrated “the inappropriateness” of this ban, decided in 2019, and that Brussels had in any case a “wide discretion” in the fisheries, exclusive competence of the Union.

The news of the CJEU’s decision was greeted with relief by The Chairperson of the European Parliament Committee on Fisheries (PECH Committee), Pierre Karleskind to tweeted, “The European Parliament and the Council said “No” in 2019. The Court of Justice of the European Union says “No”. No is no. No electric fishing in Europe.”

Dutch MEP and advocator of electric-pulse fishing, Peter van Dalen (ChristenUnie) said the the ruling particularly disappointing, and said that as far as he is concerned, electric-pulse fishing has been unjustly banned, prompted by “a lying lobby from France ”. 

Van Dalen sees a small opportunity: soon ‘the pulse’ will be discussed again in the European Parliament. Bert-Jan Ruissen, MEP of the SGP, says that it is now up to the European legislator to reverse the ban.
